You agree not to reproduce, duplicate, copy, sell, resell, exploit, or commercially use any portion of our website or Services without our prior written permission.
Headings are provided for convenience and do not limit or otherwise affect these Terms.
3. PRODUCT INFORMATION
We make reasonable efforts to present our products accurately, including their descriptions, measurements, weights, colors, materials, origins, photographs, videos, prices, and availability.
However, product colors and details may appear differently depending on lighting, photography, screen settings, device type, and other factors. Dimensions and weights may be approximate unless expressly identified as exact.
Natural gemstones, minerals, fossils, crystals, carvings, jewelry, and stone décor may contain variations in:

• Size
• Weight
• Transparency
• Texture
• Mineral inclusions
• Matrix
• Veining
• Surface characteristics
• Natural cavities
• Formation marks
• Minor irregularities
These natural characteristics are part of each product’s formation and individuality. They are not considered defects unless the product is materially different from its description or arrives damaged.
4. ONE-OF-A-KIND PRODUCTS AND STOCK PHOTOGRAPHY
Some Earth Treasures products are individually photographed, and the customer will receive the exact item shown.
Other listings may use a stock, representative, or reference image. When a listing identifies an image as a stock or representative image, the product received may vary naturally in color, pattern, shape, dimensions, weight, mineral inclusions, or other characteristics.
When applicable, these expected variations will be disclosed in the product description. A natural variation consistent with the listing is not considered damage, a defect, or a fulfillment error.
If receiving the exact specimen shown is important to you, please contact us before placing your order.
5. PRODUCT AVAILABILITY
Many Earth Treasures products are one of a kind or available in limited quantities.
Placing an item in your shopping cart does not reserve it. A product is not reserved until checkout is completed and payment is accepted.
Inventory information may occasionally be delayed or inaccurate because of simultaneous online and in-store sales, inventory adjustments, technical errors, or synchronization delays.
If a purchased item is unavailable, we may cancel the affected item and issue a refund to the original payment method. We may also contact you to offer a comparable replacement, but you are not required to accept a substitute.
6. PRICES AND BILLING INFORMATION
Product prices are displayed in the currency indicated on the website. Prices, promotions, discounts, and product availability may change without notice.
Applicable shipping charges, taxes, duties, and other charges will be displayed at checkout when reasonably available.
We reserve the right to correct pricing, description, inventory, typographical, calculation, or other errors. If an error affects an order you have already placed, we may contact you for instructions or cancel the affected item and issue a refund.
You agree to provide current, complete, and accurate billing, payment, contact, and shipping information. You also agree to promptly update information associated with your account or order when necessary.
We may limit or cancel quantities purchased per person, household, customer account, payment method, billing address, shipping address, or order.
7. ORDER ACCEPTANCE
An order confirmation does not necessarily constitute final acceptance of an order. It confirms that we received your order request.
We reserve the right to review, accept, decline, limit, or cancel an order before shipment. Reasons may include:

• Payment authorization problems
• Suspected fraud or unauthorized activity
• Shipping restrictions
• Orders appearing to be intended for unauthorized resale

If we cancel a paid order, we will refund the canceled amount to the original payment method.

Payments are processed through Shopify and authorized third-party payment providers. We generally do not directly store complete payment-card information.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges.
Installment-payment services, accelerated checkout services, or other third-party payment options may be governed by additional terms established by their respective providers.
9. SHIPPING AND DELIVERY
Shipping destinations, processing estimates, carrier options, delivery estimates, tracking availability, signature requirements, international shipping terms, and other shipping conditions are described in our Shipping Policy.
Shipping and delivery dates are estimates and are not guarantees unless expressly stated otherwise.
Earth Treasures is not responsible for delays caused by carriers, customs authorities, weather, natural disasters, labor interruptions, incorrect addresses, security inspections, or circumstances outside our reasonable control.
International customers are responsible for applicable customs duties, import taxes, brokerage charges, and other government-imposed fees unless checkout expressly states otherwise.
Our Shipping Policy is incorporated into these Terms by reference.
10. RETURNS, REFUNDS, EXCHANGES, AND FINAL-SALE PRODUCTS
Returns, refunds, exchanges, cancellations, damaged-item reports, and eligibility requirements are governed by our Return and Refund Policy.
Eligible preference-based returns must be requested within 14 calendar days after delivery and must satisfy all conditions stated in the Return and Refund Policy.
Claims involving an item that arrived damaged, an incorrect item, or a product that is materially different from its listing must be reported within three calendar days after delivery. Customers must retain the item and all packaging and provide the requested documentation and photographs.
Products priced at $1,000 USD or more are final sale for preference-based returns. This rule applies to customers in the United States, Canada, and international destinations, except where applicable law provides a non-waivable right.
Products specifically identified as rare specimens, museum-grade specimens, final sale, custom, personalized, or clearance may also be ineligible for preference-based returns.
Gift cards are final sale except where otherwise required by applicable law.
Nothing in these Terms limits any mandatory consumer right that cannot lawfully be waived.
Our Return and Refund Policy is incorporated into these Terms by reference.
11. EXCHANGES
Because many products are unique or limited in quantity, an identical replacement may not always be available.
When an exchange is approved and the same product is available, the replacement will generally be shipped after the returned product is received and inspected.
For preference-based exchanges, the customer is responsible for return shipping and replacement shipping unless otherwise stated.
If an exchange results from an incorrect, damaged, or materially misrepresented item and the claim is approved, Earth Treasures will pay the reasonable return and replacement shipping costs.
If the same product is unavailable, we may offer a comparable product, store credit, or an eligible refund. Any price difference must be paid or refunded as applicable.
12. ORDER CANCELLATIONS
Cancellation requests should be submitted as soon as possible.
We cannot guarantee that an order can be canceled after it has entered processing, packing, fulfillment, or shipment.
If an order has already shipped, the applicable Return and Refund Policy will govern.
13. OPTIONAL AND THIRD-PARTY SERVICES
We may provide access to features, tools, payment services, applications, social-media integrations, or websites operated by third parties.
We do not control third-party services and are not responsible for their content, availability, privacy practices, security, accuracy, or performance.
Your use of a third-party service may be governed by that provider’s terms and privacy policy. You should review those terms before using the service.
14. REVIEWS, COMMENTS, AND USER SUBMISSIONS
If you submit a review, photograph, comment, suggestion, testimonial, or other material to us, you represent that:
